General Terms and Conditions (T&C)

This is an unofficial English translation of our Terms and Conditions under German law. In case of discrepancy, the German version is binding.
§ 1 Scope
- These General Terms and Conditions (T&C) apply to the use of Vogtareuth airfield (EDNV), operated by Auer Flugplatz GmbH, Am Eisertsfeld 2A, 83569 Vogtareuth, Germany (hereinafter "Operator").
- They apply to all pilots, aircraft owners and other users of the airfield (hereinafter "User").
- By using the airfield, the User accepts these T&C. Deviating conditions of the User apply only with the express written consent of the Operator.
§ 2 Conditions of use
- The airfield may only be used by aircraft that comply with the approved operating conditions (max. 2,000 kg MTOW for fixed-wing aircraft, max. 5,700 kg MTOW for helicopters).
- Every use requires a valid PPR approval (Prior Permission Required) unless the "uncontrolled operations" procedure (Fliegen ohne Betriebsleiter) has been approved.
- The User is obliged to provide proof of a valid pilot's licence and the required insurance.
- The operating regulations of airfield EDNV in their respectively valid version form part of these T&C.
§ 3 Fees and payment
- Landing fees are charged for the use of the airfield in accordance with the respectively valid fee schedule.
- Fees are due immediately after landing and are to be paid to the airfield operator in cash or via PayPal.
- In the event of late payment, the Operator is entitled to charge statutory default interest and prohibit further use of the airfield.
- Additional fees (e.g. for providing an operator on site, surcharges for unclosed flight plans or non-compliant behaviour) are calculated according to the fee schedule.
§ 4 User obligations
- The User is obliged to comply with all aviation regulations, the operating regulations and instructions of the airfield management.
- Take-off and landing reports must be documented in the main flight log without delay (electronically via V-Tower or in writing).
- Before each take-off, the User must ensure that the runway and taxiways are in a safe operating condition.
- Any defects, damage or safety-relevant incidents identified must be reported to the Operator without delay.
- Aircraft may only be parked in designated areas and must be properly secured.
§ 5 Liability
- Use of the airfield is at the User's own risk.
- The Operator is only liable for damages arising from intent or gross negligence of the Operator or its vicarious agents.
- Liability for slight negligence is excluded, unless essential contractual obligations or damages from injury to life, body or health are affected.
- The User is liable for all damages that they or their aircraft cause at the airfield, to the Operator's facilities or to third parties.
- The User shall indemnify the Operator against any claims by third parties arising from the User's use of the airfield.
§ 6 Fuel (AVGAS 100LL)
- Refuelling with AVGAS 100LL is only possible in the presence of an airfield operator or an authorised person.
- The User must observe the refuelling regulations and safety instructions.
- The User is liable for any damage caused by improper refuelling by the User.
§ 7 Rights of residence and eviction
- The Operator exercises rights of residence over the entire airfield premises.
- In the event of violations of these T&C, the operating regulations or instructions of the airfield management, the Operator may evict the User from the premises and issue a ban on use.
- In urgent cases (particularly when operational safety is endangered), eviction may occur immediately and without prior warning.
§ 8 Data protection and video surveillance
- The airfield is equipped with video cameras (CCTV) for security surveillance. Notice signs are posted at the entrances.
- The processing of personal data is carried out in accordance with our Privacy Policy.
§ 9 Changes to the T&C
- The Operator reserves the right to change these T&C at any time. Changes will be published on the website.
- Use of the airfield after publication of changed T&C is deemed to be consent to the new conditions.
§ 10 Final provisions
- The law of the Federal Republic of Germany applies.
- The place of jurisdiction is, as far as legally permissible, the registered office of the Operator.
- Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely corresponds to the economic purpose of the invalid provision.
